Shipping & Returns
All products supplied by Data Logger Store (DLS ) shall be in accordance with the following terms and conditions unless otherwise stated in writing:
These Terms and Conditions govern all sales quotations and sales of components, equipment, parts, and other products.
These Terms and Conditions shall take precedence over any terms and conditions which appear on Buyer's order or other form or any other writing or electronic transmission from Buyer.
Orders and Acceptance of Orders
By submitting an order to DLS,Buyer agrees to be subject to these Terms and Conditions in their entirety. All orders must be submitted in writing (including, without limitation, by electronic mail, via on line store). Where applicable, reference shall be made to a particular DLS Quotation or Proposal under which they are being submitted. No order shall be binding upon DLS unless and until such order is accepted (or otherwise processed) by DLS at its principal office in Rowville, Victoria.
Prices and Taxes
Prices of Product and services shall be as specified on DLS 's then current list price and/or in the DLS ’s web site, unless otherwise stated by DLS in writing.
Unless otherwise specified in writing by DLS, prices quoted in the web sites are EXCLUSIVE of Australian Goods and Services Tax, or other taxes or governmental charges of any nature whatsoever, now or hereafter enacted, or any other fees, bonds or other assessments. All such taxes, governmental charges, fees, bonds and assessments are paid by Buyer unless Buyer provides DLS with a proper exemption certificate.
Unless specifically agreed to by DLS in writing, shipments shall be dispatched only upon receipt of full and complete payment as per prices specified in the website and/or as per invoice(s) presented to the buyer, inclusive of Goods and Services Tax, Freight charges and any other prices as specified. All attempts shall be made by DLS to ship orders within 3 working days of receipt of full payment or of such lead times advised by DLS If a buyer had not received an order within 10 days, the buyer shall notify DLS via Email. In the event that an item is out of stock, DLS shall inform the buyer at their earliest convenience.
In the case of whole sale buyers with pre-approved credit where Buyer's credit is or has become unacceptable to DLS,in its sole discretion, DLS may, at its option, terminate the order, refuse to make shipment or refuse to make further shipments, in each case unless and until payment is made by Buyer or satisfactory security for payment is received by DLS prior to shipment.
In the absence of specific instructions, DLS will select the carrier but shall not be deemed thereby to assume any liability in connection with the shipment, nor shall the carrier be construed to be the agent of DLS . Buyer must provide its own insurance if required. Title and risk of loss or damage shall pass from DLS to Buyer upon delivery by DLS to the possession of the carrier. Any claims for loss, damage, or non-delivery shall be filed with the carrier. Unless otherwise specified in writing by DLS, Buyer is responsible for all site preparation and for receiving, storing, installing, starting up and maintaining all Products. In its sole discretion, DLS may provide a quotation for services to assist Buyer in some or all of these functions if requested.
The estimated shipping schedule stated or confirmed by DLS is based on DLS 's prompt receipt of all necessary information and/or goods from Buyer to properly process the order, and does not constitute a commitment to deliver Product in accordance therewith. DLS will use reasonable efforts to ship on or before the estimated shipping dates. Should these reasonable efforts entail additional costs as a result of actions or inactions of parties outside the control of DLS,including, without limitation, those of Buyer, DLS shall be entitled to additional compensation.
Terms and Methods of Payment
All payments are to be made in Australian Dollars. Unless otherwise specified in writing by DLS,all payments are due prior to any products been dispatched. In the case of whole sale customers with approved credit, all payments are due net 30 days from date of invoice. Without limiting any other remedies available to it at law or in equity, DLS shall have the right to terminate the order or to suspend further deliveries under any order and agreement with Buyer in the event that Buyer fails to make any payment to DLS when due. DLS may recover all costs of collecting past due amounts (including reasonable legal fees and expenses).
Conditions of Warranties
To the extent that DLS has relied upon any specifications, information, representation of operating conditions or other data or information supplied by Buyer to DLS in the selection or design of Product and/or provision of services, and in the event that actual operating conditions or other conditions differ from those represented by Buyer and relied upon by DLS,any warranties or other provisions that are affected by such conditions shall terminate, unless otherwise mutually agreed upon in writing. Upon any nonpayment by Buyer when due, all warranties and other obligations of DLS with respect to Product delivered and/or services provided by DLS to Buyer shall terminate. All PST products come with a 12-month standard warranty unless specified. Consumables such as batteries, probes, etc. are not covered under the standard warranty.
Return of products
Whilst customer satisfaction is first priority at DLS, no products shall be returned without prior written approval of DLS.
In the event a product been faulty upon delivery or is not as described, DLS will gladly exchange the item or refund buyer’s credit card. All returns are subject to DLS receiving the product back within 7 days of purchase. Products must be returned with their original packaging and, must still be in an unused and saleable condition.
Orders accepted by DLS may be cancelled by Buyer only with the written consent of DLS and upon Buyer's reimbursement of DLS for all losses, damages, costs, lost profits and expenses arising from such cancellation. DLS shall have the right to cancel any order placed, or to refuse, or to delay, the shipment thereof for failure of Buyer to make all payments when due to DLS, or any other reasonable requirements established by DLS,or for any acts or omissions of Buyer that delay DLS 's performance. In the event of bankruptcy or insolvency of Buyer, or in the event any proceeding is brought by or against Buyer, voluntarily or involuntarily, under any provision of the insolvency law, DLS shall be entitled to cancel any order then outstanding, at any time during the period allowed for filing claims against the estate, and shall receive reimbursements for its reasonable and proper cancellation charges.
Goods Return Policy
The Customer must obtain a Goods Return Authorisation (GRA) from the Company or download from the site, prior to returning any goods. Any goods returned must be received by the Company within 14 days of the original invoice date or ship date whichever is later, and must be undamaged and in original undamaged packaging. Goods returned failing to meet these criteria and/or not accompanied by a completed GRA, will be returned to the Customer at the Customer’s expense. Certain goods (including software, books and batteries) are excluded from this right of return and may not be returned under any circumstances.
Please note that the warranty does not apply for damage or malfunction due to improper use and inadequate care of products. Before returning please check the condition of batteries and electrodes etc. If in doubt, please call the service department
An inspection/testing fee of $90.00 + GST plus return shipping charges may apply if NO FAULT IS FOUND on returned products for service. Additional repair charges apply, if applicable for products out of warranty.
If the Products ordered are to be exported from Australia, the quoted shipping dates are subject to receipt of all export documents and authorizations. Products exported will be exempted from Australian Goods and Services Tax.
